1. Acceptance of the general conditions of sale
1.1 The contract stipulated between SAPERI LOCALI srl and the CUSTOMER must be considered concluded with the acceptance, even partial, of the order by SAPERI LOCALI srl. This acceptance is considered tacit, unless otherwise communicated in any manner to the CUSTOMER. By placing an order in the various ways provided, the CUSTOMER declares to have read all the information provided to him during the purchase procedure, and to fully accept the general conditions and payment transcribed below.
1.2 If the CUSTOMER is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity), once the online purchase procedure is completed, he will print or save an electronic copy and otherwise keep these terms and conditions of sale, in compliance with the provisions of art. 3 and 4 of the Italian Legislative Decree no. 185/1999 on distance sales.
1.3 Any right of the CUSTOMER to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damage to persons and / or property, caused by the non-acceptance, even partial, of an order.

2. Method of purchase
2.1 The CUSTOMER can only purchase the products in the electronic catalog of SAPERI LOCALI srl at the time of placing the order and viewable online at the address (URL) http://www.saperilocali.com, as described in the relevant information sheets. It is understood that the image accompanying the description of a product may not be fully representative of its features but differ in color, size, volume, weight, accessory products in the picture. The photo is reproduced only to indicate the type of product that you intend to purchase, while only the product description is representative of the quality of the product.
2.2 The correct receipt of the order is confirmed by SAPERI LOCALI srl by an e-mail reply, sent to the e-mail address communicated by the CUSTOMER. This confirmation message will contain Date and Time of execution of the order and a 'Customer Order Number', to be used in any further communication with SAPERI LOCALI srl. The message re-proposes all the data entered by the CUSTOMER who undertakes to verify its correctness and to promptly communicate any corrections, according to the procedures described in this document. The provision of a cellular telephone number allows SAPERI LOCALI srl and the Courier responsible to further inform the CUSTOMER of the exact time of delivery of the goods and / or to agree on the most suitable time for the CUSTOMER.
2.3 For each order placed on http://www.saperilocali.com, an invoice/receipt will be issued and sent, in paper format, together with the ordered goods (the same can be requested or sent, in pdf format, by e-mail to the holder In this case, this document is valid and the CUSTOMER is obliged to print a hard copy and to keep it as per Article 14 of Italian Presidential Decree no. 445/2000 and Italian Decree Law no. 52/2004).
2.4 For the issuance of the invoice, the information provided by the CUSTOMER at the time of the order shall prevail. No change in the invoice will be possible after the issuance of the same.
2.5 In case of non-acceptance of the order, SAPERI LOCALI srl guarantees timely communication to the CUSTOMER. SAPERI LOCALI srl reserves the right to cancel orders considered unreliable without prior notice. For example, and not exhaustively, an order is considered untrustworthy if, the email address and / or mobile phone provided at the time of order is not true, does not match the person who placed the order, is not active. In this circumstance, if the CUSTOMER has made the payment and this is already accredited, SAPERI LOCALI srl will proceed to the immediate transfer of the total amount of the order.

3. Method of payment
3.1 Credit card and PayPal. In the case of purchase of goods with payment methods Credit Card or PayPal, the transaction will still take place through the secure PayPal server. At no time during the purchase process SAPERI LOCALI srl can know the information relating to the buyer's credit card, transmitted via a secure connection directly to the PayPal site that manages the transaction. No IT archive of SAPERI LOCALI srl will keep this data. In no case SAPERI LOCALI srl can therefore be held responsible for any fraudulent and improper use of credit cards by third parties, upon payment of purchase products.
3.2 Cash payment. Unless otherwise specified in the cashier form of http://www.saperilocali.com, this form of payment is only possible for purchases with direct collection at the affiliated local points of sale of SAPERI LOCALI.
3.3 Early Bank Transfer. In case of payment by bank transfer in advance, the amount ordered by the CUSTOMER will be kept busy until the actual crediting by the bank of the sum due on the bank account of SAPERI LOCALI srl. This accreditation must take place within 4 working days from the date of acceptance of the order. Times of order fulfillment depend on the credit speed of the bank and are averaged around 3 working days. To speed up the order processing time, it is suggested to send to info@saperilocali.it a pdf copy of the bank accountant of the bank transfer with indication of the CRO or any other traceability code.
3.4 Currency and freedom of choice. All amounts displayed on http://www.saperilocali.com are expressed in Euro, which is the reference currency for making any form of payment. The CUSTOMER has the freedom to choose, at the time of the conclusion of the order, his preference on the possible payment method.

4. Delivery methods and costs
4.1 For all purchases that will be delivered in countries not belonging to the European Community, Livigno and Campione d'Italia, any customs fees will be charged to the recipient. SAPERI LOCALI has no control over import customs duties that may vary from country to country. Contact the customs office of your country to check the import costs or, ask information about to SAPERI LOCALI srl by writing to info@saperilocali.it before making the purchase.
4.2 For each order placed on http://www.saperilocali.com, SAPERI LOCALI srl will issue the relative DDT
(accompanying transport document), in hard copy and, on request, in pdf, which proves the delivery of the goods to the Courier and, through this, to the CUSTOMER.
4.3 Delivery costs depend on the weight of the products purchased, varying with the weight category provided by the Courier where the actual weight of the goods purchased has fallen. The value of the delivery cost, including VAT
and reduced the cost of delivery to the expense of Saperi Locali srl, is shown in the PAY SHEET form at the time of purchase, that is, in the "Estimate of shipment and taxes" function of the SHOPPING CART. The collection of goods at points of sale or affiliated with SAPERI LOCALI srl is not subject to delivery costs charged to the CUSTOMER. The payment of the price of delivery of goods is anticipated by the CUSTOMER at the time of order confirmation and payment in the various methods chosen when ordering. Except for the expenses necessary or deemed useful by the Courier for the customs operations required by the country in transit or destination of the goods, nothing is more due by the CUSTOMER than the amount already paid at the time of order confirmation. Any specific requests for additional services of delivery, such as the supplement for delivery to the upper floors on the ground floor, for delivery to Venice, and the Italian minor islands, delivery to Livigno and Campione d'Italia, for stock, agreed delivery, delivery by phone call, etc., require additional costs and must be agreed with SAPERI LOCALI srl before confirming the order.
4.4 No responsibility can be attributed to SAPERI LOCALI srl in case of delay in the order or delivery of the order. Delivery times are indicative and
, in any case, cannot exceed 20 working days, unless termination of the contract and reimbursement of the amount paid to the CUSTOMER.
4.5 Delivery refers to the street level. Delivery to another floor must be specified in the order notes and agreed in advance with the order confirmation with SAPERI LOCALI srl. In fact, the delivery to other floors, other than the street level, could involve an additional fee by the Courier that will be paid by SAPERI LOCALI srl on the final sum of the goods purchased.

4.6 At the time of delivery of the goods by the courier appointed, the CUSTOMER is required to check:
a) that the number of packages delivered corresponds to that indicated in the transport document
b) that the packaging is intact, undamaged, wet or otherwise altered, even in the sealing materials (adhesive tape or metal straps).
4.7 Any damage to the packaging and / or the product or the mismatch in the number of packages or particulars, must be immediately notified to the Courier, affixing the wording "ACCEPTING WITH RESERVE OF CONTROL" in the delivery receipt. Once the Courier's document has been signed, the CUSTOMER cannot make any objection regarding the external characteristics of the goods delivered. Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported to info@saperilocali.it within 7 days of delivery.
4.8 Once the goods have been delivered by SAPERI LOCALI srl to the designated Courier, the CUSTOMER can no longer make changes to the place of delivery indicated as "Recipient" during registration of the CUSTOMER and / or confirmation of the Order in the Pay Sheet form called "CASSA" of this platform. In this regard, in the event that the delivery is not successful at the address indicated at the time of order and the customer has not collected the goods at the warehouses of the Courier appointed within a fixed deadline and expressly communicated to the CUSTOMER by Courier via phone call or email indicated in the order, the goods will be returned to the warehouses of SAPERI LOCALI srl, which will charge the CUSTOMER the cost incurred for the stop in the warehouses of the Courier, for the outward journey and return of the goods at its warehouses and for the packaging costs of the goods. The sum of these expenses will be deducted from the reimbursement of the anticipated price by the CUSTOMER for the purchase and delivery of the products.
4.9 In the case of non-collection of the goods within the terms indicated by the Courier or failing within 5 working days from making it available to the CUSTOMER, for reasons not attributable to the CUSTOMER, the order will be automatically canceled by SAPERI LOCALI srl, which will proceed to recover the related expenses incurred therein as indicated above.

5. Withdrawal
5.1 In compliance with the provisions of Italian Legislative Decree 6 September 2005 no. 206 (and subsequent amendments and additions), the CUSTOMER, if not satisfied with the products purchased at SAPERI LOCALI srl, can return the products themselves, provided they are intact, and obtain the reimbursement of the price already paid at the time of prepayment, or exchange goods of the same type and brand or replacement with other assets of its choice up to offset the value of the advance payment.
5.2 Mode of operation. To this end, the CUSTOMER must contact SAPERI LOCALI within 14 days of delivery of the products, by sending a communication via returned receipt registered letter (A.R.) (to the following address: Saperi Locali, Via Salara Vecchia, 5/22 - 65128 Pescara - IT), or via PEC – electronic certified email (to the following address: saperilocali@pec.it), containing all the information necessary and useful for a correct processing of the practice of return and refund, or exchange or replacement. This communication must necessarily contain all of the following:
a) the express wish of the CUSTOMER to want to withdraw in whole or in part from the purchase contract;
b) the number and copy of the document (invoice
/receipt - transport document) proving the purchase of the order with respect to which it intends to exercise the right of withdrawal;
c) the description and the codes of the products with respect to which the right of withdrawal is exercised;
d) precise instructions about the willingness to change goods of the same type and brand or the replacement with other assets of his choice up to offset the value of the advance payment. In this case, the change of goods or the substitution with other goods is equivalent to a new contract of sale.
5.3 In the event that a refund of the payment is requested, the re-crediting of the sum, including shipping costs, will be carried out by SAPERI LOCALI srl within 14 days of receipt of the communication by registered letter A.R. or PEC mentioned above.
5.4 Following receipt of the communication with which the CUSTOMER communicates his / her desire to exercise the right of withdrawal, SAPERI LOCALI srl, having checked the correspondence to the above-mentioned requisites, will agree, also via e-mail, with the CUSTOMER the modalities with the which to return the products that must be intact.
5.5 The product intends intact when its packaging has not been opened, altered, damaged or defaced, or, without prejudice to the integrity of the package, the product has been subjected to a treatment and / or thermal, light, magnetic and / or conditioning or sound waves that have altered / changed the properties and qualities owned by the good at the time of sale.
5.6 However, the right to withdraw from the sales contract remains excluded when:
a) the sale of goods made to measure or clearly personalized;
b) an asset has been purchased whose return to Saperi Locali srl is likely to deteriorate it, i.e. it expires or it must be consumed preferably within 30 days from the date of delivery of the goods;
c) a sealed good that has not been returned for hygienic reasons or related to health protection has been sold and the product has been opened after its delivery;
d) a good has been sold which, after delivery, is, by its nature, inseparably mixed with other goods;
e) an asset was sold, the price of which was agreed upon at the time of conclusion of the sales contract and whose delivery could only take place after confirming the purchase order, linked to a promotional campaign promoted by SAPERI LOCALI srl
(i.e., free transport costs, r-estate18 coupon or pay-back promotional campaign);
f) it is a purchase made on the occasion of a public auction;
g) it is a provision of catering services if the contract provides for a specific date or period of performance.

6. Guarantees
6.1 All products sold by SAPERI LOCALI srl are covered by the manufacturer's standard warranty and, where applicable, by the warranty for conformity defects, pursuant to Italian law, DL no. 24/2002.
6.2 To use the warranty rights, the CUSTOMER must keep the invoice
/receipt (or the Transport Document delivered by the Courier). In any case, no warranty claim is granted to the CUSTOMER after the expiry date or preferable use of the product, or, for the conservation of the product in poor environmental conditions. Food, integrator and cosmetic products must always be stored in healthy, fresh (do not exceed 20° C or less as indicated in the product label) and dry, because they can maintain the organoleptic and health conditions of the label in an optimal way.
6.3 The warranty according to the Italian law, DL no. 24/2002, applies to the product that presents a lack of conformity, provided that the product itself has been used correctly, respecting its intended use and as may be provided in the attached technical documentation. This guarantee is reserved to the private consumer (a natural person who buys the goods for purposes not related to his professional activity or makes the purchase without indicating in the order form a reference of VAT number). In case of lack of conformity, SAPERI LOCALI srl will replace the product with another similar product, or similar if accepted by the CUSTOMER, or to return or reduce the price, until the sale contract is terminated. The warranty applies only to the product, so any additional and round shipping costs are charged to the CUSTOMER.
6.4 The time required to replace the product depends exclusively on the presence of stock and, in case of reordering, the production, storage and delivery policies of the manufacturer. SAPERI LOCALI srl will notify the CUSTOMER by email and / or text message to the mobile phone number indicated by the CUSTOMER in the original order.
6.5 In the event that, for any reason, it is not able to provide its CUSTOMER with a product under warranty, SAPERI LOCALI srl may proceed, in agreement with the CUSTOMER, to return the entire amount paid or to replace it with a product of equal or superior characteristics.
6.6 No damage can be requested to SAPERI LOCALI srl for any delays in making substitutions.
6.7 In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the CUSTOMER in the original packaging, complete in all its parts; to limit damage to the original packaging, we recommend, when possible, to put it in a second box; in all cases, the affixing of labels or adhesive tapes directly onto the original packaging of the product should be avoided.

7. Compliance
7.1 SAPERI LOCALI srl declares that all the products present in the catalog and marketed through the http://www.saperilocali.com platform, comply with Italian law and European Union standards. SAPERI LOCALI srl is not liable in the event of any discrepancy in the product purchased compared to the standards of countries not belonging to the European Union and / or their failure to approve the country of delivery and / or consumption.
7.2 However, the direct responsibility of the manufacturer for inherent faults, for omitted declarations or unfounded claims declared on the product label remains firm.

8. Privacy
8.1 The personal data requested when placing the order are collected and processed by SAPERI LOCALI srl in order to meet the express requests of the customer and will not under any circumstances and transferred to third parties for purposes other than the proper fulfillment of the contract sale.
8.2 SAPERI LOCALI srl guarantees its CLIENTS to compliance with the regulations on the processing of personal data, governed by the Italian privacy code referred to in Decree Law no. 196 of 30.06.2003

9. Complaints
9.1 Any complaint must be addressed, by registered letter (A.R.) to SAPERI LOCALI srl, Via Salara Vecchia, 5/22 - 65128 Pescara (IT), or through PEC to: sapilocali@pec.it, always indicating the reference number of the order or the reason for the claim.
9.2 In the event of a claim on an order, the indication of the order number is mandatory for speedy handling of the claim.

10. Tax information
10.1 The VAT on products purchased and on the transport service is calculated separately and applied according to the rate of reference to each item / service ordered. The tax is calculated net of applicable discounts.
10.2 The amount of tax appears during the order process.
10.3 The price of the item shown on the platform is inclusive of VAT, as well as the cost of shipping.
10.4 Items purchased for shipment to a European Union country may not be subject to the VAT rate
, in force in Italy, unless otherwise provided for by law.

10. Applicable law
10.1 The contract of sale between the CUSTOMER and SAPERI LOCALI srl is concluded in Italy and governed by Italian law. For the solution of a possible civil or commercial dispute arising from the conclusion of the distance sale contract, the competent court of Pescara is elected as the competent court.
